1 payment

1.1 we must receive full payment for the whole price of the goods that you order before your order can be accepted.

1.2 we accept the following methods of payment: credit cards, debit cards & cheques. please make cheques payable to tonic t-shirts ltd and post them with your contact details and full details of your order to the contact address shown below. as soon as cheques have been cleared we will process your order.

1.3 once we have received payment we will confirm that your order has been accepted by sending you an email to the email address you give on your order form.

1.4 our acceptance of your order brings into existence a legally binding contract between us, that is you the customer & tonic t-shirts ltd.

2 price

2.1 the prices payable for goods that you order are set out on our website. all prices are inclusive of taxes and delivery charges unless stated otherwise.

2.2 discount offers, whether voucher-based or shopping cart-based, are not valid in conjunction with any other offer.

3 delivery of goods

3.1 there is no delivery charge on retail orders. please contact us for information on delivery charges for wholesale orders.

3.2 it may not be possible for us to deliver to some locations.

3.3 we will deliver the goods ordered by you to the address you give us for delivery at the time you make your order.

3.4 delivery will be made as soon as possible after your order has been accepted & in any event within 30 days of your order. we currently process and dispatch online orders at least once a week, usually within 48 hours.

3.5 you will become the owner of the goods you have ordered when they have been delivered to you. once goods have been delivered to you they will be held at your own risk & we will not be liable for their loss or destruction.

3.6 in the event that you wish to return an item or items to us for exchange or refund, you are liable for any postage costs and for any items lost in the post. we recommend that you obtain a proof of posting or send the item(s) using a trackable service. we are happy to exchange or refund any item in a saleable condition which is returned to us at ...

4 right to cancel your contract with us

4.1 you may cancel your contract with us for the goods you order at any time up to the end of the 7th working day from the date you receive the ordered goods. you do not need to give us any reason for cancelling your contract with us nor will you have to pay a penalty.

4.2 to cancel your contract with us you must notify us in writing.

4.3 if you received the goods before you cancel your contract then you must send the goods back to our contact address at your own cost & risk. if you cancel your contract but we have already processed the goods for delivery you must not unpack the goods when they are received by you & you must send the goods back to us at our contact address at your own cost & risk as soon as possible.

4.4 once you have notified us that you are cancelling your contract, any sum debited to us from your credit or debit card will be re-credited to your account as soon as possible & in any event within 30 days of your order PROVIDED THAT the goods in question are returned by you & received by us in the condition they were in when delivered to you. if you do not return the goods delivered to you or do not pay the costs of delivery, we shall be entitled to deduct the direct costs of recovering the goods from the amount to be re-credited to you.

4.5 we reserve the right to cancel the contract between us if:
4.5.1 we have insufficient stock to deliver the goods you have ordered, or
4.5.2 we do not deliver to your area, or
4.5.3 one or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.

5 liability

5.1 if the goods we deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us in writing at our contact address of the problem within 10 working days of the delivery of the goods in question.

5.2 if you do not receive goods ordered by you within 30 days of the date on which you ordered them, we shall have no liability to you unless you notify us in writing at our contact address of the problem within 40 days of the date on which you ordered the goods.

7 events beyond our control

7.1 in addition to online sales we also process offline sales which are not linked to our stock database, and it is possible that an item will be out of stock following an offline sale yet will be temporarily shown as still being available from our online shop. in the event that an item ordered from this website is out of stock we will contact you immediately to offer you an alternative or a refund.

7.2 we shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, other natural catastrophe, fire, explosion or accident.

8 privacy policy

we operate a strict security policy regarding the storage and disclosure of any information given by you. we offer our assurance of total confidentiality and promise that none of the information you provide us with will be disclosed to any to other companies.

tonic t-shirts will however disclose customers' personal data if compelled to do so by law.

tonic t-shirts reserves the right to notify or provide such information to the relevant authority only if we believe an emergency, illegal activity or some other reasonable basis exists for so-doing.

9 privacy

you acknowledge & agree to be bound by the terms and conditions of our privacy policy.

10 governing law

the contract between us shall be governed by and interpreted in accordance with English Law and the English courts shall have jurisdiction to resolve any disputes between us.
